The European Chemicals Agency (ECHA) Board of Appeal has issued a decision on a compliance check regarding the substance di-tert-butyl 1,1,4,4-tetramethyltetramethylene diperoxide. The case involved appellants Nouryon Functional Chemicals B.V., Arkema GmbH, PERGAN Hilfsstoffe für Industrielle Prozesse GmbH, and United Initiators GmbH.

In summary, the appellants were required to submit extensive information, including an extended one-generation reproductive toxicity study (EOGRTS). The ECHA mandated cohorts 1A, 1B, 2A, and 2B. The appellants contested the requirement for investigations on learning and memory function.

The Board of Appeal ruled in favor of the appellants regarding the investigations on learning and memory function, annulling that part of the decision. However, the requirement for EOGRTS, including cohorts 1A, 1B, 2A, and 2B, remains. The deadline for submission is December 26, 2026. The appeal fee has been refunded partially.
