The General Court has fully supported the arguments of the European Commission and ECHA to restrict the two siloxanes. It considered that neither ECHA’s Risk Assessment Committee nor the Commission had committed manifest errors of assessment in their opinion and decision making leading to the restriction.
The case was initiated by the Global Silicones Council and others who were seeking for an annulment of the Commission Regulation on the restriction concerning D4 and D5 in wash-off cosmetic products. ECHA intervened in support of the European Commission.
The restriction has applied since February 2020.
