The Chairman of the Board of Appeal of the European Chemicals Agency (ECHA) has announced the closure of case A-007-2023 following the withdrawal of the appeal by Compañía Española de Petróleos, S.A.U. (CEPSA) from Spain.

The appeal was filed in response to a decision made by the Agency on 9 February 2023 regarding a testing proposal for the substance m-xylene under Article 40 of the REACH Regulation.

The Agency's decision required CEPSA to provide information on various aspects, including an extended one-generation reproductive toxicity study, developmental neurotoxicity investigations, and assessments of learning and memory function. However, on 8 June 2023, the Agency rectified the decision by withdrawing it entirely due to procedural deficiencies in the statement of reasons.

Subsequently, on 20 June 2023, CEPSA withdrew its appeal, leading to the closure of the case. The Chairman also confirmed the refund of the appeal fee in accordance with the regulations.CONTINUE
