The Decree Supreme No. 031-2023-SA, published in the Official Gazette of Peru on December 13, 2023, approves the Regulation for the Regulation and Inspection of Dangerous Substances for Domestic, Industrial and/or Public Health Use. This regulation aims to prevent damage caused by the improper selection, handling, and use of dangerous substances. It establishes a classification system for dangerous substances, defines labeling requirements, and outlines procedures for registration, authorization, and inspection of dangerous substances. The regulation also establishes procedures for the management of hazardous waste generated from the use of dangerous substances.

The regulation is divided into four titles:

Title I: General Provisions

This title defines the scope and objectives of the regulation, establishes the classification system for dangerous substances, and sets out definitions of key terms.

Title II: Classification, Labeling, and Packaging

This title sets out the requirements for classifying, labeling, and packaging of dangerous substances. It establishes the criteria for classifying dangerous substances, defines labeling requirements for different types of packaging, and sets out the requirements for packaging dangerous substances.

Title III: Registration, Authorization, and Importation

This title sets out the procedures for registering, authorizing, and importing dangerous substances. It defines the requirements for registering dangerous substances, establishes the procedures for obtaining authorization to manufacture or import dangerous substances, and sets out the requirements for importing dangerous substances.

Title IV: Inspection, Control, and Compliance

This title establishes the procedures for inspecting, controlling, and enforcing compliance with the regulation. It defines the responsibilities of manufacturers, importers, distributors, and users of dangerous substances, and sets out the procedures for inspections, audits, and enforcement actions.

The regulation contains detailed provisions on each of these topics and is intended to provide a comprehensive framework for regulating the use of dangerous substances in Peru.
