Shell Chemicals Withdraws Appeal Against ECHA's Decision on p-Xylene Testing Proposal

In a recent announcement by the European Chemicals Agency (ECHA), Shell Chemicals Europe B.V. from the Netherlands has withdrawn its appeal against a decision made by the agency regarding the testing proposal for the substance p-xylene.

The Agency had requested Shell Chemicals Europe B.V. to provide additional information, including an extended one-generation reproductive toxicity study, developmental neurotoxicity investigations, and assessments of learning and memory function. However, the Appellant argued that the Agency breached Article 40 and Annex X by failing to review the testing proposal properly and relied on information related to other substances without justifiable concern.

In response, the Executive Director of the Agency rectified the Contested Decision by entirely withdrawing it, leading to the withdrawal of the appeal by Shell Chemicals Europe B.V.

The case was subsequently closed by the Chairman of the Board of Appeal.
