The Environmental Protection Agency (EPA) has implemented a new rule effective since August 7, 2023, pertaining to the safeguarding of confidential business information (CBI) claims made within Toxic Substances Control Act (TSCA) submissions. Companies submitting information under TSCA, desiring confidentiality protection, must adhere to these fresh CBI claim requirements, or risk their information becoming public.

The rule aims to standardize and streamline the CBI claim process, minimize deficient claims, and specify the types of information eligible for confidential treatment under TSCA.

However, the EPA has temporarily waived certain electronic reporting requirements associated with this rule until October 16, 2023, as they work to update their central data exchange (CDX) system.

Additionally, the rule faces legal challenges from the Environmental Defense Fund, highlighting the complex legal landscape surrounding CBI protection.
