Background information: Under the Rotterdam Convention on the Prior Informed Consent Procedure For Certain Hazardous Chemicals and Pesticides in International Trade, article 5 sets out the procedures for banned or severely restricted chemicals, and states that each Party that has adopted a final regulatory action (FRA) shall notify the Secretariat in writing of such action. Among the information requirements, a Party shall include indication of whether the FRA was taken on the basis of a risk or hazard evaluation and, if so, information on such evaluation, covering a reference to the relevant documentation. Furthermore, one of the main criteria of Annex II to the Rotterdam Convention for the inclusion of chemicals in Annex III of the Convention is to establish that the FRA has been taken as the consequence of a risk evaluation involving prevailing conditions within the Party taking the action.
