Jungbunzlauer Ladenburg GmbH, a German chemical company, has lodged an appeal with the European Chemicals Agency (ECHA) against a decision made under Article 42(1) of the REACH Regulation regarding the registration dossier for the substance tributyl O-acetylcitrate. The decision, which required the company to submit further information on pre-natal developmental toxicity studies, was contested by the company, which argued that the decision was in breach of Article 42, the right to good administration, and the principles of equal treatment and non-discrimination. The company also claimed that the agency failed to ensure that testing on vertebrate animals was undertaken only as a last resort. The company is seeking to have the decision annulled and remitted to the competent body of the agency for an amended decision.
