Issue - The substanc e benzene, 1-chloro-2-[2,2-dichloro-1-(4-chlorophenyl)ethyl]- (CAS RN 53-19-0; hereinafter referred to as “ mitotane”) meets the criteria for a toxic substance as set out in paragraph 64(a) of the Canadian Environmental Protection Act, 1999 (CEPA or the Act) and for virtual elimination as set out in subsection 77(4) of the Act. Mitotane is used in Canada as an essential therapeutic drug. Since mitotane met the criteria aforementioned, the Minister of the Environment and the Minister of Health (the ministers) recommended to the Governor in Council to amend Schedule 1 of the Act to add mitotane to the List of Toxic Substances in accordance with subsection 90(1) of CEPA, but are not considering limiting its essential use as a therapeutic drug in Canada.

Amendment

1 Schedule 1 to the Canadian Environmental Protection Act, 1999 is amended by adding the following in numerical order:

  • 144 Benzene, 1-chloro-2-[2,2-dichloro-1-(4- chlorophenyl)ethyl]-, which has the molecular formula C14H10Cl4
